I/We have read, understood and agree to abide by the conditions of Hire.  I/We agree to indemnify the Abruzzo & Molise Sporting Club of Wattle Grove against all actions, claims, demands and costs arising out of or in connection with the hire of this facility

Please ensure you have attached a copy of your Public Liability Insurance Cover and ensure your postal address is correct so we can post a cheque for the return of your bond.

In the event of any dispute or difference arising as to the interpretations of these conditions the decision of the Executive Committee shall be final and conclusive.

Signing to acknowledge understanding and agreeing to comply with these conditions on the Application Form is further acknowledgement of indemnifying the Club.

Terms and Conditions of Hire:

Please read these conditions carefully – before completing the Application Form

 General Conditions

• All bookings are subject to the hirer being responsible for compliance with legislative requirements including Local Laws and Regulations.
• Bookings for events will only be confirmed following receipt of the signed Application Form accompanied with the Bond due.
• Bookings will not be made to catering providers or any hirer who intends to use the hall to provide catering services to clients, or to re-book the facilities to a third party.
• No alteration may be made to a confirmed booking date without forfeiture of the bond, whether it be for a single booking, a multiple booking or part thereof.
• Hire times shall incorporate any time required for pre-functional deliveries and/or set up arrangements and must be indicated on the application form.
• Only areas hired are to be entered. Access to other areas is prohibited.
• The Club reserves the right to refuse, cancel and/or withhold the hiring of the Hall facilities should special circumstances warrant such action; Should a confirmed booking be cancelled all monies paid to Club will be refunded in such instances. A minimum period of 3 weeks’ notice shall be provided.
• The right to refuse the hiring of the Abruzzo & Molise Club facilities extends to the Club’s interpretation of what is deemed appropriate or not in each circumstance. For example any activity which may cause anti-social behaviour or complaint from properties in the vicinity would not be supported.
• Note it is the HIRERS responsibility to provide access to the hall for all deliveries or catering staff being used for the event. Club staff will not open or provide access to the hall under ANY circumstances except in the event of an emergency.
• It should be noted that the Abruzzo & Molise Club does not give any warranty as to the suitability of the Premises for the stated purposes of the Hirer, and whilst the Abruzzo & Molise Club takes reasonable care to present the Premises in sound operational condition, the Abruzzo & Molise Club rejects any responsibility for any event or circumstance that is beyond the Club’s control which may adversely impact upon the Hirer’s operation and use of the Premises. Should such circumstances eventuate the Hirer acknowledges and accepts that it will not be entitled to any refund, partial or whole, of any monies that may have been paid to the Club as part of this Hire Agreement.  Any decision to refund any monies is to be at the sole discretion of the Executive Committee of the Abruzzo & Molise Club.
• Trading in Public Places- If you plan to sell merchandise, have a chargeable service or have any exchanges of money on the premises during the event, you must apply to the Environmental Health Services at the City of Kalamunda for a Trading in Public Places Permit 14 working days before the event.

Cancellation and Payment

• Cancellation of a confirmed booking is required in writing to the Abruzzo & Molise Club. Cancellation within seven (7) days will also forfeit total hire fees paid. Booking fee is not refundable.
• The hire fee is payable to the Club at least fourteen (14) days prior to the hire date. See attached Schedule of Fees and Charges for all associated costs.  The Abruzzo & Molise Club will be under no obligation to proceed with the event if full payment has not been received.
• All fees and charges for Hall bookings are not inclusive of a 10% GST, unless legislation provides otherwise, and will be detailed on a Tax Invoice.
• The hire fee does not include cleaning.
• Bonds are GST exempt, however, any charges taken from the Bond for damages, cleaning, etc are subject to GST and will be detailed on a Tax Invoice with the return of the remainder of the Bond.
• The bond is refundable in full provided the building is left secure and there are no damages, cleaning costs or left over waste items to be deducted therefore. If the cost of damages and/or cleaning is greater than the bond paid, such additional expenses will be recoverable from the hirer.
• For rehearsals and set ups not on performance days, the current hourly charge as per the current fees and charges section will apply. The Club reserves the right to change bookings for rehearsals where a booking for a performance is received for the same night.
• The hirer is not permitted to extend the hire time on the night of the function. Hirers; including caterers, bar staff and any guests must vacate the facilities within thirty (30) minutes of the hire time.  Failure to comply with this will result in a penalty charge being equal to double the appropriate hourly rate.
• All bookings which fall outside of the current financial year (FY) will be charged at the rates as approved by the Club in that FY Schedule of Fees and Charges – not at the rates at time of booking.
• Please allow 2-3 weeks after your event for a bond refund.

Damage

• All breakage’s, i.e. glass etc must be cleaned up immediately. If necessary, the function should cease until broken glass is removed (this is for the safety of the public).
• The hirer is liable for all damages.
• Any faults or damage to the Hall or equipment should be reported to the Abruzzo & Molise Club President on 0408902966.

Display And Signage

• The use of masking tape, blue tac, nails, hooks, staples or any other fixing device is prohibited on any internal or external surface, including the walls, doors or stage. Any paint chips will result in a penalty from the bond.
• A banner professionally sign written can be hung in the Community Hall (2400mm wide by 850mm high). Hirer is responsible for taking signs in and out.
• No trapeze, rope, cable or any other item, other than lighting equipment, is permitted to be hung from the roof of the Hall under any circumstances.

At the Event

• Committee staff has the authority to act on Club’s behalf during a function and shall be allowed entrance at any time.
• If a Committee member is required to attend to any matter outside of normal working hours the hirer will be charged the cost of the call out (minimum four hours). Staff is ONLY on call for emergency building maintenance issues.   All issues are to be addressed in the Risk Management Plan and if necessary directed to the WA Police.
• Confetti is prohibited from use in all Hall facilities. Failure to comply will result in the hirer being charged for extra cleaning. All areas used must be left clean and tidy, with rubbish placed in bins provided.
• Smoke, bubble or confetti machines and/or naked flames are not permitted in the Hall under any circumstances due to OH&S and safety requirements.
• Emergency Exit doors must be checked that they are closed at the end of the evening.
• All lights must be turned off after use.
• The Club does not provide a duty caretaker or security officer. If a security presence is required it is the responsibility of the hirer to organise and pay for.  Security may be a condition of hire for large events and should be based on (2) two for the first 100 patrons and then 1 (one) for every 50 patrons after that.  A copy of the receipt confirming the security guards must forwarded to the Bookings Officer prior to the event.
• Keys and Alarm Code

• Keys and alarm code will be handed to the client at an arranged time before the date of hire.
• Any keys given to the Hirer by the Committee must be returned at the end of the function in the key return box. Bond will be held until all keys are returned. A charge of $200 will be deducted from bond for any keys lost, misplaced or damaged.
• The alarm must be activated when leaving the premises at the end of the function.  The Abruzzo & Molise Sporting Club has a monitored alarm system and we are notified of the time the alarm is activated. If the alarm is not activated by 2am our monitoring company contacts security and a member of committee and a charge of $200 will apply

Protection of People and Property

• Insofar as compliance with the requirements of the hire conditions permits, the hirer shall:
  • Provide all things and take all measures necessary to protect people and property.
  • Prevent nuisance and unreasonable noise and disturbance.
    • The hirer shall have current insurance cover for:
  • Public Liability to the value of $10,000,000. If a hirer does not have Public Liability cover insurance cover it may be available through the Municipal Insurance Broking Services of WA’s Community Groups Insurance Facility. Forms can be found on the Local Government Insurance Services website lgiswa.com.au.
  • Workers’ Compensation to the full extent of liability under the Workers’ Compensation Act (if applicable).
• A copy of the insurance Certificate of Currency (for the specific event and indemnifying The Abruzzo & Molise club as listed below).
• The hirer shall indemnify the Abruzzo & Molise Club against:
  • Loss of or damage to property of the Club, including existing property.
  • Claims by any person against the Abruzzo & Molise Club in respect of personal injury or death or loss of or damage to any property arising out of or as a consequence of the actions of the hirer.

Liquor Consumption and Sale Approvals

• If you wish to consume liquor, those serving must have their current Responsible Service of Liquor Permit and a security guard must be present. A Liquor License will be required from the Department of Racing, Gaming and Liquor on 9425 1888 if the liquor will be sold or provided under a cover charge.

If the club sell liquor we have staff that hare the RSLP and bar manager licence.

• If you plan to sell merchandise, have a chargeable service or have any exchanges of money on the premises during the event, you must apply to the Environmental Health Services at the Shire of Kalamunda for a Trading in Public Places Permit fourteen (14) working days before the event.

Copyright and Public Performance of Music

• The hirer shall be responsible for any infringement of copyright in connection with the performance of any musical, literary or dramatic works on any Club reserve.
• If performing at the hall you maybe required to obtain an Australasian Performing Right Association (APRA) and Phonographic Performance Company of Australia (PPCA) live performance licenses. Please contact APRA (08) 9382 8299 and PPCA on (02) 9267 7877.
